§ 24. Civil penalty.

Supplemental to or in lieu of the remedies of termination of the franchise for breach thereof and contract remedies such as specific performance, the county at its option through the county manager or his designee may in addition to other remedies he may have, impose a civil penalty of two hundred dollars ($200.00) per day liquidated damages for each and every day ATMC fails to commence and diligently pursue each of the requirements of this franchise or for each and every day ATMC fails to comply herein, except for those failures by ATMC caused by circumstances beyond ATMC control. The decision of the county shall be final unless litigated.
