§ 9. Insurance.

  • (a)

    CPC shall obtain at its expense the following insurance policies:

    (1)

    A general comprehensive public liability insurance policy indemnifying, defending, and saving harmless county, its officers, boards, commissions, agents or employees from any and all claims by any person whatsoever for injury or death of a person or persons occasioned or alleged to have been occasioned by the operation of CPC under the franchise granted herein. Said insurance shall be in an amount of at least five hundred thousand dollars ($500,000.00) per personal injury or death of any one (1) person and one million dollars ($1,000,000.00) for personal injury or death of any two (2) or more persons in any one occurrence.

    (2)

    Property damage insurance indemnifying, defending and saving harmless the county, its officers, boards, commissions, agents, or employees from and against all claims by any person whatsoever for property damage occasioned or alleged to have been occasioned by the operation of CPC under the franchise granted herein, in an amount of at least five hundred thousand dollars ($500,000.00) for property damages in any one occurrence.

    (3)

    Insurance in the amount of one million dollars ($1,000,000.00) for all other types of liability.

    (b)

    All of the foregoing insurance contracts shall be in a form satisfactory to county. They shall be issued and maintained by companies authorized to do business in the State of North Carolina acceptable to county and shall be kept in full force and effect by CPC during the term of this franchise and until completion of all obligations of this franchise. The contracts shall contain provisions requiring that thirty (30) days written notice of any cancellation be given to both county and CPC. A copy of each policy shall be filed with the county by CPC.

    (c)

    CPC shall comply with all State rules and regulations concerning workers compensation insurance as provided in G.S. Chapter 97.
