§ 3. Grant.

(a)

County hereby grants to BLP, its successors and assigns, the right, privilege, and franchise to acquire, construct and operate a cable television system within the county, exclusive of areas within the boundaries of incorporated municipalities; and to sell and supply audio and visual cable television services within the franchise area subject to conditions and restrictions set forth herein.

(b)

County, insofar as it has the power to do so, hereby grants to BLP the right to construct, maintain, and operate in or upon the streets, highways, sidewalks, bridges, and other public ways and lands within the franchise area, those facilities and that equipment needed to accomplish the purpose of this franchise.

(c)

The rights, privileges and franchise granted herein shall terminate fifteen (15) years from the date of the signing of this ordinance. Not later than six (6) months prior thereto, county may review grantee's performance under this franchise at a public hearing. If county finds grantee's performance to have been satisfactory, county may renew the rights, privileges and franchise granted in here for an additional period of fifteen (15) years, upon application by BLP for such renewal and under such terms and conditions as the parties may agree.

(d)

This franchise shall not be exclusive and shall not restrict the county in any manner in the exercise of any franchising or other regulatory power which it now has or which it hereafter may be granted by federal, state or local law.
