§ 24. Civil penalty.

Supplemental to or in lieu of the remedies of termination of the franchise for breach thereof and contract remedies such as specific performance, the county at its option through the county manager or his designee may impose a civil penalty of two hundred dollars ($200.00) per day as liquidated damages for each and every day the grantee fails to commence and diligently pursue each of the requirements of this franchise or for each and every day the grantee fails to comply herein, except for those failures by the grantee caused by circumstances beyond the grantee's control. The grantee shall be given reasonable notice, an opportunity to be heard and an opportunity to cure prior to enforcement of penalty. The decision of the county shall be final unless litigated.
